The General Terms of Procurement regulate the distance selling between

SBELLNECK SLU and the user or client, in accordance with the legal provisions, in particular,

Law 7/1998, of 13 April, on General Terms of Procurement, Law 3/2014, of

27 March approving the revised text of the General Law for the Defence of

Consumers and Users, Royal Decree 1906/1999, of 17 December 1999, which

regulates Telephone or Electronic Contracting with general terms, Law

15/1999, of 13 December, on Protection of Personal Data, Law 7/1996, of 15

January on Regulation of Retail Commerce, and Law 34/2002 of 11June, on Services of

the Information Society and Electronic Commerce.

 

SBELLNECK SLU reserves the right to make any changes it deems necessary,

without prior notice, in the General Terms. These changes may be made

through the website by any means allowed by law and will be obligatory

while they remain published on the website until

they are validly modified by others thereafter. However, SBELLNECK SLU reserves

the right to apply, in certain cases, Special Terms of Procurement

with preference to these General Terms when deemed necessary,

announcing them in due time and appropriately.

In accordance with the provisions of Law 15/1999 on Protection of Personal Data,

SBELLNECK SLU informs users that personal data gathered during the

registration process and subsequent purchase, will be entered into a file under its

responsibility, in order to process said actions on behalf of the user and manage

possibility of exercising rights of access, rectification, cancellation and opposition by

As long as the user does not communicate otherwise, it is understood that your data have not been modified,

that you agree to notify us of any change and that we have your consent

provided. These data will not be public. You are responsible for confidentially and

responsibly handling the username and password received upon registration as

a client, which cannot is non-transferable. You may change the information registered at any

user can delete records deemed unnecessary for viewing

 

Once the checkout process is finished, the client will receive a confirmation by

The client, upon receiving the product at the delivery address provided, will receive an invoice or

Offer and validity

 

In the event of a product on sale, the price of the sale and its validity will always be

indicated alongside its essential characteristics.

 

In compliance with current regulations, SBELLNECK SLU offers information about all

sale items, their characteristics and prices. However, SBELLNECK SLU reserves the

right to remove, replace or change products offered through its website

by a simple change in the content thereof. This way, products offered

in each moment through the website are governed by the General Terms of Procurement

in force in each case. The company also has the option to stop offering, without prior notice

and at any time, access to the aforementioned products.

 

Essential characteristics of products

 

The products offered in our online store include a photo and the

essential characteristics. This is the information received from the manufacturer.

The product colour, seen in the photo is not binding. It is defined in the characteristics.

 

Warranties

 

All products offered on the website come with a commercial supplier warranty.

SBELLNECK SLU has a after sales service and while the warranty is valid, the client

Prices

 

All products indicate the sales price in Euros and include the Value Added Tax (IVA).

If any other taxes are applicable, they will be indicated.

 

Shipping costs

 

Shipping costs will be borne by the Client and are shown separately in the order form and invoice.

All purchases will be delivered by the courier LOGIEXPRESS or UPS Monday through Friday, except Saturdays, Sundays and local and national holidays, being sent two business days after the confirmation of acceptance of the order proposal, based on the indicated availability. Sbellneck is not responsible for delays that are unforeseeable and/or exclusively attributed to the Courier Company.

For security reasons, products purchase through the Website will only be delivered to the address expressly identified by the Client in the checkout process. You must provide the Client’s signature, or another designated adult over 18, upon delivery. SBELLNECK SLU does not make deliveries to PO boxes.

If paying by bank transfer, product deliveries will be made once Sbellneck receives the full amount of the transfer.

The Client or designated representative must be present at the indicated delivery address on the goods delivery order. Upon delivery of goods by the Courier Company, the Client must verify:

a) The number of items delivered corresponds to that indicated on the delivery order, and

b) The packaging and seals are intact and in good condition – not altered in any way. Any damage to the delivery package and/or product, or discrepancies in the number of items or documentation, must be indicated immediately in writing on the courier’s delivery order. Once the Courier Company’s document has been signed and no objection has been made by the Client, the Client may not make any objection in relation to the external characteristics of the package delivered.

 

Payment methods and order fulfilment

 

The client can pay the amount of their order by choosing any of the following methods.

During the checkout process, you must indicate your choice:

Credit card VISA,MAESTRO OR MASTERCARD

 

All operations involving the transmission of personal or bank information are made

using a secure environment, a server based on standard security technology, SSL

(Secure Sockets Layer). All the information you provide to us in encrypted through the network.

Also, this information about your credit is entered directly on the bank’s website

in the POS (the bank’s Point of Sale) and is not entered or registered on

any SBELLNECK SLU server.

 

When paying with a VISA or MASTERCARD, you must always provide the following information:

card number, expiration date and validation code, which matches the last three

numbers of the number printed on the back of your VISA or MASTERCARD,

thus, offering more guarantees for the security of the transaction.

This payment method is only valid online.

 

When the amount of a purchase has been fraudulently or improperly charged using the

the number of a card, the holder can demand the immediate cancellation of the charge.

In such a case, the corresponding charge and refund will be noted in the provider and holder’s account and

will be made as swiftly as possible.

However, if the purchase had been effectively carried out by the cardholder and the

demand for refund is not the result of having exercised the right of withdrawal

or resolution and, therefore, had improperly demanded the cancellation of the corresponding

charge, the Client is obligated to SBELLNECK SLU to pay the damages and

losses caused as a result of said cancellation.

 

Bank Transfer

 

When you select the bank transfer, you receive an email along with the order

confirmation with the bank information for SBELLNECK SLU.

It is very important when transferring to indicate the order number in the subject,

as well as your name and surname, and make the transfer within 3 days after the

date of the order confirmation to validate it.

In any case, it the order will not be considered until our administration department has the bank transfer confirmation.

Remember that the payment must be made in EUROS and that all possible fee

for exchange and transfers are at your expense.

For bank transfers made outside of Spain, it is very important when

making the transfer to instruct your bank to handle the charges of commissions

in origin, those bank fees and expenses that correspond to your organisation.

Otherwise, SBELLNECK SLU may halt the delivery of your order if the full amount

is not received.

Possible exchange and bank fees are payable by the client.

 

SBELLNECK SLU is committed to delivering the order in a maximum of thirty days from the day after the order is placed.

The availability of the products offered by SBELLNECK SLU may vary depending on

client demand. Although SBELLNECK SLU updates stock periodically, the

product requested by the client may be sold out at that time. In the event that an item

is unavailable, SBELLNECK SLU will notify the client when it becomes aware of the

situation via email. The period of this communication

will be no greater than 30 days. SBELLNECK SLU can

give a double option of: providing the client with a product of similar characteristics

or superior quality with no price increase, or, unless justifiable and demonstrable by

SBELLNECK SLU, within the same period, refund the amounts paid for the cancelled

order. In the supposed case that SBELLNECK SLU does not make this payment within the prescribed period, the

buyer can demand a refund of twice the amount due, without affecting their

right to compensation.

 

Right to cancellation, refunds and complaints

 

The buyer has a minimum period of fourteen calendar days for cancellation, starting the

day the client receives the product, without any penalty and need to give a reason.

 

Exercising the right of cancellation must be carried out through a notice by

telephone call to SBELLNECK SLU, writing an email to the address:

info@sbellneck.com, or through the cancellation form.

 

According to the provisions of Article 103 of Law 3/2014, of 27 March, which amends

the revised text of the General Law for the Defence of Consumers and Users, the supply

of services or goods made to specifications of the

consumer or clearly personalised, or which, due to their nature, cannot be returned or

are likely to deteriorate or expire quickly, are exempt from cancellation.

- Refund

 

The client must return or directly deliver the product to SBELLNECK SLU, to the

address AKETXE Nº 4 CH-5 48100, LAUKARIZ (BISCAY), without undue delay, and in

any event, no later than fourteen calendar days from the date of formalising the

right to cancel the contract. It will be deemed as meeting the deadline if the client makes

the product return before the end of this period.

The client will bear the cost of returning the product.

In any case, returned products must be in perfect condition, unused and in their

original packaging. Therefore, in order to avoid problems in transport, we ask that the

package be safely wrapped and secured. Once received, we will check its state.

When we are satisfied that the article/s, as well as possible

components, accessories, promotional gifts and documentation are accounted for and in

perfect condition, we will return the money paid.

 

- Payment refund

 

Reimbursement of the amounts received from the client will be made using the same

payment methods used by the client, as long as it is not otherwise stipulated.

SBELLNECK SLU may withhold the reimbursement until receiving the product, reason for

cancellation or until the client delivers the proof of return thereof, as long as the

first condition is satisfied.

 

In case of unreasonable delay on behalf of SBELLNECK SLU, regarding the return of

amounts paid, the client may demand twice the amount paid, without affecting the right

to compensation for the damage and losses suffered in excess thereof.

 

- Return of defective product

 

In the event that the product is not in good condition and the causes attributed to this

are not the result of the client, the client is entitled to a product return, by informing

SBELLNECK SLU about the reason for the return through and of the means provided in

these terms of procurement, and with no cost for the client. The refund

due to defect or poor state of the product will not be considered a right of

SBELLNECK SLU agrees to bear the cost of the refund and replacing the product

with a new one in accordance with the terms accepted at the time of sale.

Jurisdiction

 

SBELLNECK SLU also reserves the right to bring any civil or criminal action

it deems appropriate for improper use of its website and content, or for

breach of these conditions.

The relationship between the user and the provider shall be governed by applicable regulations in

the Spanish territory. Should there be any dispute, the parties may submit their disputes

to arbitration or resort to the ordinary courts, complying with the regulations on jurisdiction and

competence in this matter. SBELLNECK SLU is registered in BISCAY, Spain.
